Terms of Service

1. The Service

DoctorLync is a multi-tenant clinic management platform. It covers appointment booking, patient records, prescription issuing, and video consultations. Features available to you depend on the plan your organisation has subscribed to. AtriVex may add, modify, or remove features with reasonable notice.

2. Accounts and access

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at support@atrivextech.com of any unauthorised use. Each individual must have their own account; sharing credentials is not permitted.

3. Your data

You retain all rights to data you submit ("Customer Data"). You grant AtriVex a limited licence to process Customer Data solely to provide and improve the Service, subject to our Privacy Policy and any Data Processing Agreement (DPA) in force between us.

AtriVex does not access, analyse, or share Customer Data except as described in the Privacy Policy or as required by law. For patients' personal data, the clinic is the Data Fiduciary and AtriVex processes it on the clinic's behalf, as its Data Processor under India's Digital Personal Data Protection Act, 2023.

4. Acceptable use

You may not:

• Reverse-engineer, scrape, or interfere with the Service.
• Upload malware or attempt to gain unauthorised access.
• Use the Service to violate any law, infringe any right, or harm others.
• Resell the Service without a written reseller agreement.
• Enter a patient's data without the basis the law requires, such as their consent.

5. Fees and billing

Fees are per the plan selected at sign-up or as agreed in a separate order form. Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. Fees are non-refundable except as required by law or specified in a written agreement. Failed payments result in up to 3 retries; access is suspended after 7 days of non-payment and data is held for 30 days before permanent deletion.

6. Suspension and termination

AtriVex may suspend or terminate accounts that violate these Terms or carry unpaid balances. You may cancel at any time from the Subscription page in DoctorLync, or by writing to support@atrivextech.com. On termination, Customer Data is available for export for 30 days, then deleted.

7. Service levels and uptime

AtriVex works to keep the Service available at all times; it does not guarantee a level of uptime except where an Enterprise Order Form sets one. Planned maintenance is announced via support@atrivextech.com at least 24 hours in advance.

8. Warranties and disclaimers

The Service is provided "as is" without warranties of any kind, except as required by law or specified in a separate written agreement. DoctorLync is a practice-management tool; clinical decisions remain the sole responsibility of the licensed healthcare provider.

9. Patients and clinics

AtriVex provides DoctorLync as a platform only. Each clinic, and each doctor working in it, is an independent provider of its own services, and AtriVex is not a party to the relationship between a patient and a clinic. AtriVex does not provide medical care, does not employ or supervise the doctors, and does not set or collect the clinic's fees.

Matters between a patient and a clinic are for that clinic to resolve, including:

• appointments: availability, waiting times, and changes or cancellations by the clinic;
• fees, bills, payments, refunds and disputes about any of them;
• diagnosis, prescriptions, treatment and the content of medical records;
• the conduct of the clinic's doctors and staff.

AtriVex is not responsible or liable for these matters. Ratings and reviews that patients leave for a clinic are their own opinions, not AtriVex's. For a problem with the app or the website itself, such as signing in or a page that does not load, write to support@atrivextech.com.

10. Limitation of liability

To the maximum extent permitted by law, AtriVex's total liability for any claim arising from these Terms is limited to the fees paid in the 12 months preceding the claim. AtriVex is not liable for indirect, incidental, or consequential damages.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.

12. Changes

AtriVex may update these Terms with at least 30 days' notice for material changes, delivered by email and an in-app banner. Continued use after the effective date constitutes acceptance.
